It could be possible the seller bought them under the impression they were legit. Either way it's a tricky situation. Hope it works out.

It's an ongoing struggle. But it is very difficult to fight it. Luxury goods are always sought after and if there is a demand for cheap (but crap) oakleys - there will be a factory somewhere that will try to benefit from it.
